Terms & Conditions

Acceptance

By downloading, installing, or using Vye (the “App”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not download or use the App.

Vye is published by Harutyun Kloyan (“we”, “us”, “our”) and distributed exclusively through the Apple App Store. These Terms are a legal agreement between you and us, not between you and Apple.

Eligibility

You must be old enough to form a binding contract under the laws of your country of residence to accept these Terms. If you are not, you may only use Vye with the involvement and agreement of a parent or legal guardian who accepts these Terms on your behalf.

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Vye on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and the Apple Licensed Application End User License Agreement.

Purchase and Unlock

Vye’s features are unlocked through a one-time, non-consumable in-app purchase processed by the Apple App Store. There is no subscription, no recurring charge, and no free trial. Once purchased, the unlock is tied to your Apple Account and may be restored on any compatible device signed in with the same Apple Account, including through Apple’s Family Sharing where you have enabled it.

References in the App or our marketing to “lifetime access”, “forever”, or similar terms mean access to the unlocked features for as long as Vye remains available on the App Store and remains compatible with then-current Apple operating systems and hardware. They do not mean a perpetual or unconditional guarantee of future availability. See “Device Requirements, Updates, and Discontinuation” below.

Refunds

All purchases are processed by Apple. Refund requests are handled exclusively by Apple under Apple’s refund policies, and we have no ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com.

Your Photos and AI-Generated Edits

Vye processes your photos entirely on your device. Your photos, and any edited versions Vye generates from them, remain your property at all times. We claim no ownership of, and have no access to, any image you open, edit, or save with Vye, including images produced by Vye’s on-device AI workflows. You are responsible for ensuring that you have the necessary rights to any photo you choose to edit using Vye.

Your Feedback

If you send us suggestions, ideas, bug reports, or other feedback about the App, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use that feedback for any purpose, without obligation to you. We may incorporate your feedback into the App or other products without compensation or attribution. Feedback is provided voluntarily; you have no obligation to send it.

Intellectual Property

Vye, including its name, logo, user interface, design, source code, AI workflows, and any associated materials, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership of the App or any part of it to you.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, we (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

Third-Party Services

Vye relies on Apple frameworks and services, including Apple Intelligence, the Vision framework, Core Image, Metal, and the Photos framework. Your use of these features is also governed by Apple’s terms. Vye is not affiliated with, endorsed by, or sponsored by Apple beyond Apple’s role as the App Store distributor.

Third-Party Links

The App and this website may contain links to third-party services or websites (for example, Apple’s “Report a Problem” page for refunds). We do not control and are not responsible for the content, policies, or practices of any third-party service. Your use of any third-party service is at your own risk and subject to that third party’s own terms.

Device Requirements, Updates, and Discontinuation

Vye requires a compatible iPhone (iPhone 15 Pro or later), iOS 26 or later, and Apple Intelligence enabled. We may release updates that change features, performance, system requirements, or hardware compatibility. We are not obligated to maintain compatibility with earlier devices or operating system versions.

We may, at our discretion, discontinue the App or any of its features at any time, including in response to changes in Apple frameworks, App Store policies, or for any other reason. Where required by applicable consumer protection law, we will refund or otherwise compensate affected users in accordance with that law; otherwise, discontinuation does not entitle you to a refund.

Maintenance and Support

We are solely responsible for providing any maintenance and support for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. For support, contact us at support@vyeapp.com.

Disclaimer of Warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will produce any specific creative result.

You are responsible for maintaining your own backups of any photos you edit. We are not responsible for any loss, corruption, or modification of your photos.

Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or photos, arising out of or in connection with your use of, or inability to use, the App. Our total cumulative liability arising out of or relating to these Terms or the App will not exceed the amount you paid for Vye.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising out of your use of the App, your violation of these Terms, or your violation of any applicable law or third-party right.

Termination

These Terms remain in effect for as long as you use Vye. We may terminate or suspend your license to use the App at any time if you materially breach these Terms. Upon termination, you must stop using and delete the App. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and us, and not with Apple. We are solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support for the App, and Apple is not responsible for addressing any claims you may have relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, or claims arising under consumer protection or similar legislation.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these Terms. The remaining provisions will continue in full force and effect.

Informal Dispute Resolution

Before filing a claim against us, you agree to first try to resolve the dispute informally by contacting support@vyeapp.com and describing the issue. We will attempt to resolve the dispute in good faith within 30 days of receiving your notice. Both parties agree to participate in this informal process before initiating any formal legal action.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules. The parties agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any disputes arising out of or relating to these Terms, except where applicable consumer protection laws or mandatory local laws of your country of residence apply, and except that the Apple Media Services Terms continue to govern where they apply.
